Naczelny Sąd Administracyjny (The Supreme Administrative Court) has repealed the decison of the Wojewódzki Sąd Administracyjny(State Administrative Court) in Warsaw from February 11, 2012, which annulled the 1800 MHz frequency reservation on behalf of CenterNet and Mobyland - subsidiares of NFI Midas. Thanks to this decision they can now fully make use of their held frequencies.
In a verdict from July 26th, the Supreme Administrative Court has dismissed a complaint from Polska Telefonia Cyfrowa and has sent the case for consideration to the State Administrative Court. Therefore the decision issued by the President of Urząd Komunikacji Elektronicznej (Office of Electronic Communication) on the 30th of November, 2007 (DZC-WAP-5174-6/07(190)), on the basis of which the 1800 MHz frequency was reserved for NFI Midas' subsidiaries - CenterNet and Mobyland remains valid.
The Board of NFI Midas hopes that in further court cases, which are currently being held in the matter of the auction for the 1800 MHz frequencies, will also be settled in a positive way for the fund's subsidiaries.
